The petitioner is apprehending his arrest in connection with Rajepur P.S.Case no.152 of 2018, G.R.Case no.6339 of 2018 , registered for offences punishable under Sections 341, 447, 323, 354(B), 379 and 504/34 of the Indian Penal Code and Section 3⁄4 of the Prevention of Witch (Dian) Practices Act.. Allegation against the petitioner and other accused persons is of calling the informant as Dian and also torn her cloths and assaulted her and further allegation is of snatching of Mangalsutra.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and no specific allegation has been attributed against them and he happens to be Gotia of the informant.

Patna High Court Cr.Misc. No.1319 of 2019(2) dt.18-01-2019 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran at Motihari in connection with Rajepur P.S.Case No.152 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case..

With the aforesaid observation, this application is allowed.
