The petitioner Gumani Yadav seeks bail in a case under Section 302 and other sections of the Indian Penal Code. Manoj Yadav @ Chandsi Yadav alleged that Gumani Yadav, the petitioner, caught the collar of Ramaji Yadav and assaulted him. In the meantime, Baliram Yadav, Bishram Yadav, Satendra Yadav and Meena Devi assaulted Ramaji Yadav with Farsa, Lathi, Bamboo, Gadansi. It is submitted that there is no allegation of assault against the petitioner. The petitioner is in jail since 05.05.2014. The petitioner has already remained in jail for more than one year. Satendra Yadav, who is alleged to have assaulted the deceased, has already been enlarged on bail vide order passed in Cr. Misc. No. 40166/2014. The case of the petitioner stands on better footing.
