JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 09.12.2014 in a case registered for the offences punishable under Sections 341, 323, 353, 307 and 120B of the Indian Penal Code and Section 3/4 of the Explosive Substances Act and Section 17 of Criminal Law Amendment Act.

It is alleged that the informant being S.I. of police received information while in process of raiding Novigarh mountain that I.E.D. bomb have been planted to eliminate police force when 40 feets I.E.D. underground wire were recovered. The name of the petitioner sprang up during investigation. Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati, Gaya in connection with Dumariya P.S. Case No. 36 of 2014.

Since the petitioner is accused in three other cases, learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
