The petitioner seeks bail in Phulwaria P.S. Case No. 113 of 2014, registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The mother of the victim named six persons and alleged that while she was returning with her daughter, wife of Mukhtar Rajbhar, Arun Rajbhar, Musafir Rajbhar, Asarfi Rajbhar, Rugdi Devi and Brajesh Rajbhar (the driver of the Bolero) kidnapped her minor daughter.

It is submitted that the victim was having love affairs with Arun Rajbhar and she herself left her house. The victim made her statement under Section 164 and she disclosed the name of three persons, namely Arun Rajbhar, Brajesh

Patna High Court Cr.Misc. No.8225 of 2015 (4) dt.05-05-2015 2/2 Rajbhar and mother of Arun Rajbhar. The victim was examined by the doctor. The doctor did not find any sign of rape. The doctor assessed the age of the victim about 18-19 years. The victim also disclosed that she had come to Gopalganj with Arun and she saw her brother Arjun.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gopalganj in connection with Phulwaria P.S. Case no. 113 of 2014.
