In the instant petition, the petitioner has prayed for the following relief(s):- "(i) For issuance of appropriate writ/writs, order, direction / directions commanding the respondents authorities for taking action against the private respondent by cancelling the sale deed No.1149 dated 01.06.2015 with respect to the homestead land of the petitioner appertaining to Tauzi No. 1031, Thana No. 338, Khata No. 178, Plot No. 1908, Area-1.116 Decimals whereby and whereunder private respondent without payment of any consideration amount and without taking required

Patna High Court CWJC No.6630 of 2017(3) dt.28-11-2024 2/2 permission from the respondent No. 3 District Magistrate got the sale deed executed from the son of the petitioner after concealment in the Caste column as 'Kanu'

instead of correct caste of petitioner 'Gond' which comes under the category of Schedule Tribe.

(ii) Petitioner further seeks any other relief/reliefs for which he is found entitled in the eye of law and in the facts and circumstances of the present case."

3. Learned counsel for the petitioner submits that this case may be disposed of with the liberty to the petitioner to file the detailed representation before the District Magistrate, Siwan for redressal of his grievance.

4. Learned counsel for the State has no objection to this prayer of the petitioner.

5. In view of the submission of the learned counsel for the petitioner, this case is disposed of with the liberty to the petitioner as prayed for.
