JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-04-2023 The present petition has been filed seeking the following relief :- "(i) For a direction to the Executive Engineer of the Bihar State Housing Board, Darbhanga Circle, Darbhanga to execute registered sale deed in favour of the petitioner with respect to the MIG House no. M/135 situated at Laheriasarai Housing Colony, Darbhanga as even after receipt of total balance consideration money of Rs. 1,17,705/- pm 08.03.2016, the former is not completing the process of

(ii) For direction to the respondent no. 4 to complete the construction work of the MIG House no. M/135 at the earliest so that the same may be amenable to accommodation."

At the outset, considering the fact that without any appropriate calculation, the respondent- Bihar State Housing Board has raised a demand of a sum of Rs. 12 lacs an odd, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the pricing committee of the respondent- Board. Liberty so sought, is granted. It is needless to state that in case, appropriate petition is filed by the petitioner before the pricing committee of the respondent- Board, within a period of four weeks from today, the pricing committee shall examine the matter and pass a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter, whereupon it shall ensure that the calculation chart is supplied to the petitioner.

The respondent- Board is then directed to take the consequential action, in pursuance to the decision taken

Patna High Court CWJC No.6678 of 2017(2) dt.17-04-2023 3/3 by the pricing committee, within a further period of four weeks, thereupon.

The writ petition stands disposed off on the aforesaid terms.
