Petitioner seeks bail in a case registered under sections 25(1-b) A, 26/35 of the Arms Act.
According to the F.I.R. on secret information police raided the house of the petitioner and after seeing the police party petitioner started fleeing away but the police party apprehended in a bamboo clump and on search recovered one single barrel gun and two live cartridges for which the petitioner could not produce any paper.
On behalf of the petitioner it is submitted that the petitioner is in custody since 24.3.2015 and charge sheet has been submitted in the case. It is further submitt4ed that one
Patna High Court Cr.Misc. No.22132 of 2015 (2) dt.16-07-2015 2/2 country made pistol and two liver cartridges are said to have been recovered from the possession of the petitioner. It is further submitted that petitioner has no criminal antecedent. It is further submitted that petitioner may be released after completion of six months in custody from 24.3.2015.
On behalf of the State it is submitted that the petitioner is named in the first information report. Considering the aforesaid facts the above named petitioner is directed to be released on bail after completion of six months in custody from 24.3.2015 on furnishing bail bond of Rs. 10,000/- (ten thousand ) with two sureties of like amount each to the satisfaction of Shri R.K. Pandey, J.M. Ist Class, Gopalganj in Kateya P.S. Case No. 43 of 2015.
