The petitioner apprehends his arrest in connection with Isuapur P.S. Case No. 260 of 2019, registered under Section 30(a) of the Bihar Excise Act.

The accusation is that on receiving secret information about keeping the illicit liquor by Rajnish Singh (petitioner) and Mukesh Kumar Singh concealing behind the temple in the village Tedha, the informant along with other police personnel reached there. On search, two plastic containers containing 200 litres spirit and 150 bottles each containing 750 ml Indian made foreign liquor were recovered from the bush, situated near the temple. Patna High Court CR. MISC. No.4875 of 2020(3) dt.10-06-2020 2/2 there disclosed the name of the Rajnish Singh (petitioner) and Mukesh Singh, indulging in keeping the illicit liquor and selling the same.

Learned counsel for the petitioner submits that it would appear from the FIR that petitioner was not apprehended at the spot nor the seized liquors were recovered from the house of the petitioner but due to dirty village politics, his name has been disclosed by the local people. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran at Chapra, in connection with Isuapur P.S. Case No. 260 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
