Learned State counsel accepts notice for respondents. Learned counsel for the petitioner is hereby directed to learned counsel for the State if it has not already served. In the instant petition, petitioner has prayed for the following relief(s):- "(a) For fixation of terminal benefits after determination of entitlement of

Patna High Court CWJC No.4778 of 2021 dt.01-02-2022 2/2 petitioner after giving benefits of 1st A.C.P. and M.A.C.P. Scheme.

(b) For any other relief for which the petitioner may be found entitled to."

Short question for consideration is whether the petitioner is entitled to 1st and 2nd ACP as of when it is due to him. In this regard, representation dated 08.08.2020 is stated to have been furnished as is evident from Annexure-4.

Therefore, the concerned respondent is hereby directed to decide the petitioner's representation for the 1st and 2nd ACP and arrears shall be calculated and disbursed to the petitioner within a period of three months from the date of receipt of this order. If the petitioner is not eligible in that event speaking order shall be passed and communicated to the petitioner.

With the aforesaid observations, the present writ petitioner stands disposed off.
