2. The petitioner apprehends his arrest in a case registered for the offence under Sections 103(1), 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that as per F.I.R. itself, it was co-accused Manish Kumar, who caused fire-arm injury on the head of informant's husband, causing his death. So far as this petitioner is concerned, he is only alleged to be member of the unlawful assembly and there is absolutely no allegation of overt act against this petitioner.

4. Learned A.P.P. for the State has opposed the bail petition.

5. Considering the same, let the above named

Patna High Court CR. MISC. No.4889 of 2026(2) dt.11-02-2026 2/2 petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Bhaptiyahi P.S. Case No. 179 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
