The petitioner is languishing in custody since 16.04.2015 in a case registered for the offences punishable under Sections 341, 323, 325, 379, 307 and 504/34 of the Indian Penal Code.
It is alleged that the petitioner assaulted the informant and snatched sixty one thousand rupees. It is further alleged that the petitioner assaulted with Farsa on the head of the mother of the informant.
It is submitted by learned counsel for the petitioner that the petitioner is nephew of the informant and in the background land dispute the accusation has been levelled.
Patna High Court Cr.Misc. No.22241 of 2015 (2) dt.09-07-2015 2/2 Subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court below. The same has been brought on record as Annexure-2. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and the injury has been found to be simple. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 296 of 2012.
