2. Petitioner seeks regular bail in a case registered for the offence punishable under section 137 ( 2 ) and 140 (3) of BNS.

3 . As per the prosecution case , informant alleged that on 14.10.2024, son of informant went to visit durga mata temple but did not return . Thereafter, informant and his relative began to search but he was not found. F.I.R., has been lodged

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., The name of the petitioner transpired during course of investigation on the confessional statement of co-accused persons. Except confessional statement there is no other material against this petitioner. He has got no concern with the alleged occurrence . Petitioner claims clean antecedent. Petitioner is in custody since 18.10.2024 . 5 . Learned counsel for the State opposed the prayer for bail and submitted that during course of investigation , it has come that this petitioner and others were seen indulged in maarpeet regarding love affairs between deceased Ayush Kumar and one Amrita Kumari. From perusal of confessional statement of injured Ayush Kumar which is recorded paragraph 33 of case diary , he stated that on 14.10.

2024 at 6:30 PM, this petitioner others called him to meet behind house of Amrita Kumari and when he reached there , this petitioner and others snatched his mobile phone and brutally assaulted him due to which he became unconscious. Doctor has found multiple injuries on the body of deceased Ayush Kumar.

6. Considering the nature of accusation , material available on record and gravity of offence , I am not inclined to
