2. The petitioner seeks bail in connection with Khanpura P.S. Case No. 298 of 2023 registered for the offence under Sections 25(1-B)(a), 26, 35 of the Arms Act.

3. As per the prosecution case, three live cartridges have been recovered from the petitioner and one loaded country made pistol was recovered from the possession of other co-accused who were travelling together.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case.

5. It is also submitted by the learned counsel for the petitioner that the petitioner has clean antecedent and he is

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Samastipur in connection with Khanpura P.S. Case No. 298 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Khanpur Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
