The petitioner is apprehending his arrest in connection with palasi P.S.Case No.14 of 2017 dated 20.1.2017 , registered for offences punishable under Sections 341, 323, 354(B), 307, 379, 504, 34 of the Indian Penal Code.
Allegation against the petitioner is of causing injury on the head of the informant.
Submission of the learned counsel for the petitioner is that the injuries are simple in nature and other co-accused persons have been granted privilege of anticipatory bail, vide order dated 28.4.2017 passed in Cr. Misc. no.19871 of 2017. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,
Patna High Court Cr.Misc. No.4417 of 2019(5) dt.22-02-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM III, Araria in connection with Palasi P.S.Case No.14 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
