Petitioner being teacher is apprehending his arrest in a case registered for the offences punishable under Sections 409, 420/34 of the Indian Penal Code. It is alleged against the petitioner that during Lok-Sabha Election, 2014 the petitioner was deputed as Polling Agent-1 at Booth No. 177 situated at Utkramit Middle School Baluwa Kurshail but he failed to perform his duty. It is submitted by learned counsel for the petitioner that due to the ill health the petitioner could not perform his duty and the petitioner has already informed to the authority about his illness. Moreover the petitioner was kept as reserved poling agent due to his illness.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the

No.22308 of 2015 (2) dt.06-07-2015 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 122 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
