This application, for grant of anticipatory bail, arises out of Town Police Station Case No. 613 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 325, 307, 427, 379, 504 and 506 of the Indian Penal Code.
My attention has been drawn to an order of this Court, dated 19.04.2018, passed in Criminal Misc. No. 23380 of 2018, whereby similar circumstanced co-accused persons have been granted anticipatory bail.
In addition, it has been submitted that the police, upon completion of investigation, have submitted report under
Patna High Court Cr.Misc. No.3004 of 2019(2) dt.23-01-2019 2/2 Section 173 of the Code of Criminal Procedure, 1973 and did not find any material against this petitioner for being put on trial. However, differing with the police report, the Court below has taken cognizance and issued summonses against these petitioners also.
Considering the facts and circumstances noted above, this application is allowed.
Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai, in connection with Town Police Station Case No. 613 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled. ragini/- (Chakradhari Sharan Singh, J.)
