JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is named in the first information report with general allegation of firing but according to prosecution case itself, neither informant nor any other person sustained any injury. Moreover, one co-accused, Puran Mandal lodged Sabour P.S. Case No. 228 of 2015 against the informant of present case and others for the occurrence of the same day and in the aforesaid case, some persons sustained injury, said to be caused by firearm.
