The petitioner seeks bail in Ara Mufassil P.S. Case No. 68 of 2008 registered under Sections 364, 302 and 201/34 of the I.P.C.

The informant suspected that Ajay Paswan, Lalan Paswan, Vishwakarma Paswan, Harendra Paswan and Upendra Paswan(petitioner) kidnapped his nephew and killed him. It is submitted that the name of the petitioner figured in the case on mere suspicion during the course of investigation. Skull was found in the orchard. Skull was sent to the Forensic Science Laboratory and it was found to be that of a person aged about 20-25 years. F.I.R. was lodged after one month of disappearance of the victim. It is submitted that similarly situated co-accused Harendra Paswan and others have already been enlarged

Patna High Court Cr.Misc. No.22818 of 2015 (2) dt.22-05-2015 2 / 2 on bail. The case of the petitioner stands on the same footing as that of Harendra Paswan and Ajay Paswan.

Considering the aforesaid facts, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IIIrd, Bhojpur at Ara, in Sessions Trial No. 29 of 2014, arising out of Ara Mufassil (Dhobaha O.P.) P.S. Case No. 68 of 2008.
