JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 This application, for grant of anticipatory bail, arises out of Samastipur Town P.S. Case No. 253 of 2018, disclosing offences under Sections 30(a) of the Bihar Prohibition of Excise Act, 2016.
Allegation is of recovery of 171 litres of liquor from the Scorpio vehicle of the petitioner.
Submission of learned counsel for the petitioner is that the vehicle from which the alleged recovery has been made, is being used for commercial transportation. Further submission is that nothing has been recovered from the conscious possession of the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let
Patna High Court Cr.Misc. No.1071 of 2019(2) dt.17-01-2019 2/2 petitioner surrender before the court below within a period of six weeks from the date of receipt of copy of this order and pray for regular bail and show the papers before the learned court below that the vehicle is a commercial vehicle and if it is so, the court below shall enlarge the petitioner on bail to his own satisfaction on furnishing bail bonds of Rs. 25,000( Rs. Twenty Five Thousand), otherwise, the court below is free to pass any order as he deems fit and proper.
