The petitioner seeks bail in a case registered for the offences punishable under sections 302, 328/34 of the Indian Penal Code.

Informant is brother of the deceased. The informant stated that his sister Sachita Devi was married with petitioner Satendra Singh in the year 2001. Six years ago Vijay Singh, father-in-law of the deceased gifted one katha of land to his son-in-law Abhay Singh. Abhay Singh wanted to take share in the land of Satendra Singh, husband of the deceased but the deceased objected.

It is submitted that all the accused persons killed

Patna High Court Cr.Misc. No.22278 of 2015 (3) dt.10-09-2015 Sachita Devi by administering poison. It is also submitted that the deceased was treated in Rahmania Nursing Home. Post mortem was held but cause of death could not be ascertained. There is nothing on record to show that the petitioner ever assaulted his wife since marriage with the deceased. Petitioner is in jail for more than one year.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IX, Motihari, East Champaran in connection with Turkauliya (Banjariya) P.S. Case No. 609 of 2014 corresponding to Sessions Trial No. 112 of 2015. (Prabhat Kumar Jha, J) Amin/- U
