Petitioner in the present case is seeking pre-arrest bail in connection with Sambhuganj P.S. Case No.63/2019 registered for the offences punishable under Sections 366(a) and 34 of the Indian Penal Code and Section 12 of POCSO Act.

Learned counsel for the petitioner submits that so far as this petitioner is concerned, in course of investigation it has come that the victim girl had no relationship with this petitioner. It was a case of love affair between the victim girl and co-accused Manish Ram. The victim girl is major as her date of birth is 05.05.2000. In the supervision note in paragraph '26' it has come that it is a case of love affair between them.

Learned APP for the State has though opposed the prayer

Patna High Court CR. MISC. No.5921 of 2020(3) dt.31-08-2020 2/2 for pre-arrest bail of the petitioner, but considering the facts and circumstances of the case, the nature of materials present in the case diary and that the petitioner has no criminal antecedent, let the petitioner above named in the event of his arrest or surrender within a period of four weeks from today in connection with Shambuganj P.S. Case No.63/2019 be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeI-cum-Special Judge (POCSO), Banka, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e.

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required; (ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (iii) a condition that the person shall not leave India without the previous permission of the Court.
