As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 24.02.2021, within four weeks of starting of Court proceeding in physical mode in normal course. This application is filed for modification of order dated 28.01.2020 passed in Criminal Miscellaneous No. 5588 of 2020 under which the petitioner, who was at serial No. 2, was allowed privilege of pre-arrest bail.
Learned counsel appearing on behalf of the petitioner submits that petitioner had been granted pre-arrest bail on 28.01.2020 passed in Criminal Miscellaneous No. 5588 of 2020 with a direction to surrender before the court below
Patna High Court CR. MISC. No.15513 of 2021(2) dt.28-07-2021 2/2 within a period of four weeks in connection with Kadamkuan P.S. Case No. 16 of 2018 (G.R. No. 337 of 2018) and he shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri Om Prakash, VI, Sub Judge-VII-cum-Additional Chief Judicial Magistrate, Patna, but due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated time.
In such view of the matter, let the time to surrender of the petitioner, namely, Rupesh Kishore Sharma, as ordered on 28.01.2020 passed in Criminal Miscellaneous No. 5588 of 2020 be further extended by six weeks from today. Accordingly, the modification application is allowed and the order dated 28.01.2020 passed in Criminal Miscellaneous No. 5588 of 2020 is modified to the above extent.
This application stands disposed of.
