JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-09-2019 Petitioner seek bail in anticipation of his arrest in connection with Rajoun P.S. Case No. 486 of 2017, registered for the offences punishable under Sections 302,328/34 of the Indian Penal Code.

Allegation against the petitioner is that who happens to be the Sautan of the informant has killed the son of the informant by administering poison.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and FSL report was called for by this Court and FSL report disclosed that no metallic alkaloidal, Glycosidal, pesticidal or volatile poison could be detected in the dark brown fluid as described above. Heard learned A.P.P. also.

Heard both sides. In view of the above facts and

No.6386 of 2019(7) dt.03-09-2019 2/2 circumstances, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Rajoun P.S. Case No. 486 of 2017, subject to the condition as laid down under Section 438

(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
