JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-11-2021 Heard Mr. Krishna Prasad Singh, learned Senior Counsel for the petitioner and Mr. Mritunjay Kumar Nirala, learned Additional Public Prosecutor for the State. The petitioner seeks bail in Kargahar P.S. Case No.07 of 2017, registered for the offences punishable under Sections 304B, 201, 120B and 34 of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.

Learned Senior Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. The petitioner is in custody since 13.03.2020 and he has got no criminal antecedent as stated in paragraph 3 of the bail petition. Learned counsel for the State opposed the prayer for bail of the petitioner and submitted that the petitioner is the

Considering the facts aforesaid and the fact that the petitioner is the husband of the deceased, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

However, the learned trial court is directed to expedite the trial of the petitioner.
