This is a petition for grant of regular bail in a case under Section 394 of the Indian Penal Code.
It is alleged that two persons armed with three nut and knife entered into the house of informant and demanded cash and on refusal by the informant, they caused injury on his nose, face and eye. Thereafter the miscreants looted cash of Rs. 25,000/- along with a mobile and fled away after locking the door from outside.
It is submitted on behalf of the petitioner that the petitioner is not named in F.I.R and nothing has been recovered from the possession of the petitioner. It is further submitted that the petitioner has not been put on T.I.P. and his name has come on
Patna High Court Cr.Misc. No.13252 of 2016 (2) dt.01-04-2016 2/2 the confessional statement of co-accused Md. Sayeem Ansari, which has got no evidentiary value in the eye of law. The petitioner is in custody since 09.01.2016.
Hence, having regard to the facts and circumstances of the case and also that the petitioner is in custody for more than two and half months, the petitioner above named is ordered to be released on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 639 of 2015 (G.R. No. 3729 of 2015).
