Sinha, learned senior counsel, assisted by Sri Sandip Kumar Gautam, learned counsel for the petitioner and learned Addl. Public Prosecutor. In this case, by order dated 06-02-2019, a report was called for regarding stage of the case, which has been received and kept at Flat 'A'. The report is dated 11-02-2019, contained in letter no. 10, sent by the Presiding Officer, Fast Track Court No.1, Begusarai.

Learned senior counsel tried to persuade the Court that it is a fit case for grant on bail on merit. He submits that post-mortem report does not corroborate the oral evidence. Accordingly, it has been argued to grant bail. Earlier, by order dated 25-06-2018, on merit the

Patna High Court CR. MISC. No.5233 of 2019(3) dt.06-03-2019 2/2 prayer for bail was already rejected. Accordingly, there is no reason to again entertain the bail petition on merit. The report indicates that framing of charge is being delayed as per instance of the petitioner, who is in jail.
