The petitioners are languishing in custody since 28.01.2015 and 30.01.2015 in a case registered for the offences punishable under section 302/34 of the Indian Penal Code and 27 of the Arms Act.
On informant that the dead body of the informant's husband is lying in the eastern side of the village, the informant went and found the dead body with gun shot injuries on the head. The informant suspected the hands of these petitioners in the alleged offence as they have some fight with the husband of the informant with regard to football game when the petitioners threatened. It is also alleged that near the place from where the
Patna High Court Cr.Misc. No.22399 of 2015 (2) dt.09-07-2015 2/2 dead body was recovered Rajan Yadav ploughing field one day prior to the occurrence.
It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled and investigation has already concluded. Statements have been made in paragraph 3 of both the petition that the petitioners have no criminal antecedent.
Considering the accusation based on suspicion and investigation has already concluded, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Hilsa P.S. Case No.313 of 2014.
