The petitioner is accused in connection with S.C./S.T. Case No. 56 of 2015 arising out of Wazirganj P.S. Case No. 56 of 2015 registered under Sections 147, 323, 341, 342, 325, 354, 504 and 307 of the Indian Penal Code.
The accusation is that a boy of village Pakari was being assaulted by six persons including the petitioner on the pretext that the said boy was outraging the modesty of a girl of their village. When informant rushed to save the boy then he was also assaulted by causing injury at his head. At that time, when villager Shankar Choudhary, Phulchand Choudhary, Ashok Coudhary and Bijendra Rajbanshi rushed to save the boy, they
Patna High Court Cr.Misc. No.13627 of 2016 (2) dt.08-04-2016 were also assaulted by lathi and stick by the accused persons. Later on, Shankar Choudhary died in course of treatment. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 09.10.2015. Learned counsel for the petitioner further submits that similarly situated co-accused, Ram Swaroop Yadav, has already been granted privilege of bail by a Bench this Court vide order dated 31.03.2016 passed in Criminal Misc. No. 9213 of 2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special District and Sessions Judge, ST/ST, Gaya, in connection with S.C./S.T. Case No. 56 of 2015 arising out of Wazirganj P.S. Case No. 56 of 2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
