The petitioner seeks regular bail in connection with Begusarai Town P.S. Case No. 57 of 2018 registered for the offence punishable under Sections 408, 420, 467, 468 and 471 of the Indian Penal Code.

The case of the prosecution in brief is that the informant is running a T.V.S. Bike Showroom where the petitioner and two other co-accused persons were working. It is alleged that the petitioner and the said two accused persons have engaged in criminal breach of trust and have misappropriated the money of customers resulting in loss of 1,22,950/- approximately.

The learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.3080 of 2019(2) dt.23-01-2019 2/2 petitioner has been falsely implicated in the present case and he is having a clean antecedent and is in custody since 27.01.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the petitioner, above named, to deposit a sum of Rs. 40,000/- before the learned trial court which shall be kept in a Fixed Deposit of a nationalized bank whereupon the petitioner shall be released on regular bail subject to such conditions as may be imposed by the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 57 of 2018.

It is needless to state that the aforesaid deposit of a sum of Rs. 40,000/- shall be subject to final outcome of the trial. The petition stands disposed of on the aforesaid terms. (Mohit Kumar Shah, J) S.Sb/- U T
