Petitioner is accused in connection with S. Tr. No. 92 of 2014/189 of 2014 arising out of Gaya Muffasil P.S. Case No. 386 of 2012 registered under Section 302 of the I.P.C. Learned counsel appearing on behalf of the petitioner submits that petitioner happens to be the husband of the deceased and earlier his prayer for bail was rejected on 28.01.2014 vide Cr. Misc. No. 21151 of 2013 taking into consideration the facts that informant Raja Kumar, son of the petitioner, was informed by his brother Mala Kumar and sister Parwati Kumari about causing assault to his mother Anita Devi by the petitioner and carrying her outside from the house and on the next day, the
Patna High Court Cr.Misc. No.4609 of 2015 (3) dt.06-05-2015 2/2 dead body was found in the semi constructed house of Balram Singh with direction to the Trial Court to conclude the trial preferably within one year. At present the S.T. No. 92 of 2014 pending in the Court of Addl. Sessions Judge-Vth, Gaya and out of five witnesses, cited in the charge sheet, excluding I.O and Doctor. Only three witnesses have been examined, including Mala Kumar, PW. 1 and Parwati Kumari, PW. 3 and they also did not support the prosecution case. The petitioner is in custody since 18.1l.2012.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Vth, Gaya in connection with S. Tr. No. 92 of 2014/189 of 2014 arising out of Gaya Muffasil P.S. Case No. 386 of 2012.
