JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-12-2018 After some argument, the learned counsel for the petitioner seeks liberty to file objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914 and in the meantime, seeks some protection.
Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file an objection under Section 9 of the Act, 1914 and in case such an objection is filed within four weeks from today, the District Certificate Officer, Samastipur shall consider the same and pass the final order.
Till the passing of the final order, no coercive action shall be taken against the petitioner in connection with Certificate Case No. 81/2017-18, pending before the District Certificate Officer, Samastipur.
Patna High Court CWJC No.23704 of 2018(2) dt.19-12-2018 2/2 It is needless to state that in case no objection is filed by the petitioner within a period of four weeks from today, the District Certificate Officer, Samastipur shall proceed ex parte and pass the final order.
