JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report which was lodged against three persons but, subsequently, when the victim was recovered and her statement was recorded under Section 164 of the Cr.P.C., she disclosed that petitioner and F.I.R named accused persons forcibly took away her and petitioner brought her to the house of his maternal aunt. Learned counsel appearing for the petitioner submits that one of the F.I.R named accused Hizbul Rahman has already been granted privilege of regular bail whereas one another F.I.R. named accused Md. Irfan has been granted privilege of anticipatory bail by different co-ordinate Benches of this Court
Patna High Court Cr.Misc. No.13947 of 2016 (2) dt.05-04-2016 2/2 and at the time of consideration of bail applications of the aforesaid persons, the co-ordinate Benches of this Court noticed that the victim was found aged about 17 to 18 years and she was in love with the petitioner and she herself eloped with the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Biraul, Darbhanga in connection with Biraul P.S.Case No. 07 of 2015.
