The petitioner seeks regular bail in connection with Mahua P.S. Case No. 615 of 2019, registered for the offence punishable under Section 379 and 411 of the Indian Penal Code.

The allegation is regarding theft of a loaded vehicle and as far as the petitioner is concerned, seven bags of beaten rice was recovered from the house of the petitioner. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 12.11.2019. It is further submitted that similarly situated co-accused persons

Patna High Court CR. MISC. No.4740 of 2020(2) dt.23-01-2020 2/2 have already been granted bail by coordinate Benches of this Court vide orders 16.1.2020 and 18.1.2020 passed in Criminal Miscellaneous No. 839 of 2020 and Criminal Miscellaneous No. 3078 of 2020.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, as also taking into account the parity of the case of the petitioner with those of the coaccused persons, who have already been granted regular bail by the coordinate Benches of this Court, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Mahua P.S. Case No. 615 of 2019.
