JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 367 C of 2017, disclosing offences under Sections 323, 498(A)of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner, who is husband of the complainant, is of subjecting his wife to cruelty with respect to demand of dowry.

Submission of learned counsel for the petitioner is that there is no allegation of demand against this petitioner and he is working as a driver and though he is ready to keep her, but she is not ready to live along with the petitioner. Heard learned A.P.P. as well as learned counsel for the

No.4029 of 2019(3) dt.13-03-2019 2/2 complainant, they have opposed the prayer for anticipatory bail of the petitioner stating that the petitioner subjected the complainant with cruelty and harassment and he has also not paying the maintenance, for that she has already filed a maintenance case.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheikhpura, in connection with Complaint Case No. 367 C of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that he shall cooperate in disposal of the maintenance case filed by the opposite party no.2 and will abide by any order passed in the maintenance case by the learned Family Court. (Vinod Kumar Sinha, J) Amjad/- U T
