BADAR ORAL ORDER 12-05-2023 The applicant is accused in Crime No.93 of 2021 registered with Govindpur Police Station for the offences punishable under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016. By this application he is seeking his release on bail during pendency of the trial. This is the second application of the applicant, the earlier one was rejected way back on 01.04.2022.
Heard the learned counsel appearing for the applicant/accused as well as learned Additional Public Prosecutor appearing for the State.
The applicant was found to be driving a truck in which 6580 litres of illicit Indian made foreign liquor of different brands was found. It is reported that owner of the truck is already released on bail. Despite direction of this Court to commence
Patna High Court CR. MISC. No.7409 of 2023(2) dt.12-05-2023 2/2 and decide the trial within a period of eight months, it is reported by both the parties that the trial has not yet begun. The applicant is undergoing pretrial detention from 17.04.2021. In this view of the matter, the following order:- i. The application is allowed.
ii. The applicant/accused in Crime No.93 of 2021 registered with Govindpur Police Station be released on bail on executing P.R. bond of Rs.10,000/- (Rupees Ten Thousand) on furnishing two sureties of the like amount each to the satisfaction of the trial court with the following conditions: - (I) The applicant/accused should cooperate the trial court in expeditious disposal of the trial against him. (II) The applicant should not repeat commission of similar offence in future and if he is found to be involved in commission of similar offence, the State is at liberty to apply for cancellation of bail granted to the applicant in the instant case.
