JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 06-05-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

Though at an earlier stage the case was registered under Sections 304B/302 of the IPC along with other allied Sections, however, after conclusion of the investigation, charge-sheet was submitted under Sections 306/34 of the IPC whereunder cognizance was also taken and accordingly, as has been submitted, charge has also been framed after commitment. Petitioner happens to be under custody since 11/12/13.

In the aforesaid facts and circumstances of the case, petitioner, Raj Kishore Gupta is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya PS. Case No. 608/2013.
