JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This is an application for grant of anticipatory bail in connection with Alauli P.S. Case No. 317 of 2018, disclosing offences under Sections 147, 341, 323, 448, 308, 379 and 504 of the Indian Penal Code.
Allegation against the petitioners and other accused persons is of assault to the informant.
Submission of learned counsel for the petitioners is that as a matter of fact the informant tried to construct Toilet (Sauchalay) on their land due to that scuffle took place between the parties and no specific allegation has been attributed against the petitioners and injuries are simple in nature. Further, they have no criminal antecedents.
