JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-04-2023 The present petition has been filed seeking the following relief :- "(i) For issuance of a writ of certiorari quashing the order dated 14.02.2017, passed by the learned Commissioner, Tirhut

Patna High Court CWJC No.6749 of 2017(2) dt.17-04-2023 2/3 at Muzaffarpur in B.L.D.R. Appeal no. 160 of 2016 mechanically and erroneously upsetting the well-consideered order dated 09.07.2016, passed by the D.C.L.R., Bettiah in B.L.D.R. case no. 28 of 2013.

(ii) To direct the respondent- authorities to protect the poor petitioner's only shelter of his large family.

(iii) To grant all other relief/ reliefs including cost and compensation to the petitioner to which he is found entitled to in the special facts and circumstances of the present case."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Bihar Land Tribunal by filing appropriate application challenging the order dated 14.02.2017, passed by the learned Commissioner, Tirhut Division, Muzaffarpur in B.L.D.R. Appeal no. 160 of 2016. Liberty so sought, is granted. It is needless to state that in case, appropriate application is filed within a period of four weeks from today, the same shall be heard on merits and disposed off, in accordance with law, by passing a reasoned and a speaking order, forthwith.
