Heard learned counsel for the petitioners as well as learned APP for the State.
In this case, the petitioners are seeking regular bail in
Patna High Court CR. MISC. No.4929 of 2022(2) dt.24-05-2022 2/2 connection with B.P. No. 3930 of 2021 arising out of G.O. 465 of 2021, registered for the offences punishable under Sections 39 (a), 56 (B) of the Bihar Prohibition and Excise Act. As per allegation, 540 litres of illicit liquor was recovered from a tempo and both the petitioners were arrested at the spot.
Learned counsel for the petitioners has submitted that the petitioners are under custody since 26.08.2021. He has also submitted that petitioner Anand Roy @ Anand Kumar has no criminal antecedents whereas petitioner Veera Noniya has criminal antecedents of two cases and in both cases he has been granted bail by the coordinate Bench of this Court.
Considering the facts and circumstances, the petitioners above-named are directed to be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 2nd-cum-Special Judge Excise, Nawada in connection with G.O. No. 465 of 2021. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
