JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In the first information report as well as in her statement recorded under Section 164 of the Cr.P.C, the informant claimed that it was co-accused, Babla who opened fire on her husband. So far as petitioner is concerned, it appears that except confessional statement of co-accused, Babla and some criminal antecedent, there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.22470 of 2015 (2) dt.03-07-2015 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No. 01 of 2015.
