ANJANA MISHRA ORAL ORDER 21-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.11.2019 on his surrender in connection with Barhara P.S. Case No.64 of 2019 registered for the offence under Sections 25(1-b)a/26/35 of the Arms Act.

Learned counsel for the petitioner submits that during the parliamentary elections, some person was possessing Masket who out of fear of the police threw the same on the verandah of the petitioner and escaped and the police finding the same on the verandah have taken the wife of the petitioner into custody and subsequently, the petitioner has also surrendered voluntarily in connection with the present case. Considering the aforementioned facts and circumstances and that the petitioner has surrendered voluntarily and has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea, in connection with Barhara P.S. Case No.64 of 2019.
