The petitioner is in custody in connection with Siwan Mufasil P.S. Case No. 454 of 2019 for the offenses under Sections 272, 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition & Excise Act, 2018.
Learned counsel for the petitioner submits that in the instant case total 17 ltrs of illegal wine was seized. Learned counsel for the petitioner further submits that nothing was recovered from the conscious possession of the petitioner. The petitioner is in custody since 02.12.2019.
Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named,
Patna High Court CR. MISC. No.5362 of 2020(2) dt.31-01-2020 2/2 be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II cum Special Judge (Excise), Siwan, in connection with Siwan Mufasil P.S. Case No. 454 of 2019. However, in the event the petitioner found involved in the similar offences in future, the court below shall be at liberty to cancel the bail of the petitioner.
