JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-09-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under Sections 374, 370 of the Indian Penal Code and Section 14 of Child Labour Distributin & Regulation Act, 1986 as well as under Sections 23, 26 of the J.J. Act.

It is a case of child trafficking.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Zakir who was caught red handed along with four children which were to be supplied to the petitioner. However, said children have not taken name of the petitioner. Petitioner has got no criminal

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Jogbani Police Station Case No. 106 of 2019 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
