JUSTICE RAJIV ROY ORAL ORDER 27-07-2023 Heard Mr. Ramchandra Singh, learned counsel for the petitioner and the State as also the Spl. P.P. for Mines. The petitioner has prayed for the following relief: (i) that this Hon'ble Court may be pleased to direct the respondent authorities to pay appropriate

Patna High Court CWJC No.7344 of 2017(4) dt.27-07-2023 2/3 compensation amount as prayed the representation dated 3.12.2015(Annexure-10 to this writ petition) because petitioner is Raiyat of land in which mining work of withdrawn of Balu/Sand is going on through the respondent authorities without permission of the petitioner;

(ii) the appropriate direction may be issued to stop the settlement for withdrawal of Balu/Sand from the Raiyati land of the petitioner without permission of the petitioner;

(iii) any other reliefs may be allowed in favour of the petitioner, for which the petitioner is duly entitled in accordance with law.

For such grievance, the petitioner should have first approached the Collector, Rohtas at Sasaram.

Considering the facts/grievance of the case, the petitioner is permitted to file a comprehensive representation before the Collector, Rohtas at Sasaram within a period of four weeks from today.

If such representation is preferred within the aforesaid period, the Collector, Rohtas at Sasaram is duty bound to pass an appropriate/reasoned order within three months thereafter.
