Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 323, 341, 325, 504, 354,of the Indian Penal Code.

As per the prosecution case, petitioner assaulted the informant with lathi and danda on her head. When the family members of the informant came to save her then accused person also assaulted them.

Learned counsel for the petitioner submits that informant and petitioner are neighbours and there is property dispute between them for which a simple occurrence of maarpit took place. Injury caused by the informant was found to be abrasion left eye brow size 1"x1/2". Petitioner is 62 years old. He has got not criminal antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate , Bhojpur at Ara in ara Nagar P.S. case no.258 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
