JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2019 The petitioner apprehends his arrest in connection with Ishuapur P.S.Case No. 50 of 2018 registered under Sections 147, 148, 149, 302, 323, 324, 341, 447, 448, 504 and 506 of the Indian penal Code.

Allegation against the petitioner is of assaulting the husband of the informant, along with other co-accused persons named in the FIR and 5-6 unknown persons, by lathi, danda and iron rod.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him and as per FIR earlier Budhu Manjhi had assaulted the husband of the informant when he enquired about misbehaviour by the deceased with his wife and petitioner has no motive to assault the deceased. However, he submits that other accused persons who are named in the FIR, have been granted privilege of

Having heard both sides and in view of the fact that other co-accused persons similarly situated, have been granted privilege of anticipatory bail, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Chapra at Saran in connection with Ishuapur P.S. Case No. 50 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
