2. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 05.07.2023 in Cr. Misc. No. 38541 of 2023.

3. The petitioner seeks bail in connection with S. T. No. 485 of 2022 arising out of Sohsarai P.S. Case No. 259 of 2019 registered for the offence punishable under Sections 147, 148, 149, 448, 302, 379 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

4. As per the prosecution case, the petitioner is said to have fired indiscriminately after which co-accused Nitish Kumar shot the deceased.
