JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Session Trial No. 421 of 2019 arising out of Gopalpur P.S. Case No. 204 of 2018 registered for the offence punishable under Section 302/34 of the Indian Penal Code.

Allegation as per F.I.R., petitioner and other accused persons brutely assaulted the deceased inside a building causing injury to his death.

Submission of the learned counsel for the petitioner is that allegation against the petitioner and one Kundan Kumar. Considering the materials on record Kundan Kumar has already been granted bail by a co-ordinate Bench of this court vide order dated 04.12.2019 passed in Cr. Misc. No. 56692 of 2019. He is in custody for about 20 months and the charges has already been

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions JudgeXIV, Patna, in connection with Sessions Trial No. 421 of 2019 arising out of Gopalpur P.S. Case No. 204 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with further condition that he will co-operate in the disposal of the trial otherwise his bail bond will be cancelled.
