JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 The petitioner apprehends his arrest in connection with Patori (Mohanpur OP) P.S.Case No. 115 of 2018 registered under Sections 304B/201/34 of the Indian penal Code. Allegation against the petitioner who happens to be the husband of the deceased , is of dowry death.

Submission of learned counsel for the petitioner is that as a matter of fact deceased was pregnant and died during treatment and after informing the informant, dead body was disposed of.

Heard learned APP also who has opposed the prayer of anticipatory bail stating that dead body was disposed of in hurried manner and she was killed within seven years of the marriage and there is allegation of demand of dowry also. Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.1518 of 2019(2) dt.23-01-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered by the learned court below on its own merit without being prejudiced by this order.

The application stands dismissed.
