JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Barachatti (Mohanpur) P.S. Case No. 309 of 2019 for the offence under Sections 30(a) (d) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 04.11.2019. He further submits that in the instant case total 24 litres bear as well as 100 Kg Mahua flower was seized from the joint house of the petitioner.

Considering the fact that the petitioner has got no criminal antecedent and the bear and Mahua flower was sized from the joint house of the petitioner, the petitioner, named above, is directed to be released on bail on furnishing bail bonds

Patna High Court CR. MISC. No.3273 of 2020(2) dt.29-01-2020 2/2 of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 309 of 2019.
